EMERGING JUDICIAL TRENDS ON UNIFORM CIVIL CODE - AN ANALYSIS
Author: Promila

It is necessary here, to evaluate the role of judiciary in respect of Article 44 of the Constitution, although like all other constitutional directives, the mandate of Article 44 too, is not enforceable in a Court of Law. And it is also necessary to mention that judiciary is not specifically included in the definition of “State” as applicable to Directive Principles enshrined in Part IV of the Constitution. Therefore, judiciary cannot be expected to have taken any direct step to ensure the implementation of the mandate. Nevertheless, the role of judiciary is much more appreciable than that of executive process, in one way or the other, towards achieving this Constitutional goal, either by upholding the validity of the unifying or partly unifying social legislation when challenged on the ground of unconstitutional discrimination or by upholding those legal provisions which if liberally interpreted would furnish uniform family law in fragments, applicable to all citizens. Thus in Shahulameedu v. Zubaida Beevi while interpreting the rule relating to wife’s maintenance contained in Section 488(3) of the (old) Criminal Procedure Code, the High Court of Kerala did not deny its benefit to the wife of a bigamous Muslim staying away from him after his second marriage. Here in this case, specifically referring to the mandate of Article 44, Justice Krishna Iyer said: “The Indian Constitution directs that the State should endeavor to have a Uniform Civil Code applicable to the entire Indian community, and indeed when motivated by a high public policy, Section 488 has made such a law. It would be improper for an Indian court to exclude any section of the community born and bred up on Indian earth from the benefits of that law…

FOOD SECURITY IN AN INTERNATIONAL PERSPECTIVE
Author: Kavita

Food security is a mean of guaranteed access of all humans to all essential nutrition necessary for their survival. It refers to condition of household’s or country’s ability to provide future physical and economic access to sufficient safe and nutritious food that fulfils the dietary needs and food preferences for living an active and healthy lifestyle. The case for urgent action in the food security is now compelling. We are at a unique moment in history as diverse factors converge to affect the demand, production and distribution of food over the next 20 to 40 years. The requirement of a growing world population will be hard to be satisfied as critical resources such as water, energy and land are becoming increasingly scarce. The food system must become sustainable, while adapting to climate change and substantially contributing to climate change mitigation. It is the need of the hour to multiply our efforts to address hunger, which continues to affect so many. Food is an essential element that all human beings must have access to in order to live. Access to the minimum essential food which is sufficient nutritionally adequate and safe as well as acceptable, physically accessible are considered to be the basic human rights. Human rights are those which are fundamental for living and for normal human existence

LEGISLATIVE AND CONSTITUTIONAL PERSPECTIVE OF RIGHTS OF DISABLED IN INDIA - AN ANALYSIS
Author: Preeti Bhardwaj

The study of the Constitutional framework is necessary as it is the root from which all the statutes draw their existence. The disability jurisprudence in the form of statutory law came into India only after 1995. Until then the persons with disability were protected under the umbrella of the Constitution of India. The framers of the Constitution were more inclined to lay down the general principles on which the State must progress and they provided the general goals which every Government must strive to achieve. Therefore, the research aims to study the document by keeping in mind, the intention of the framers. Therefore the researcher will not search for any specific provision for the disabled persons as a community, but will try to bring out better protection within these general principles. Special mention needs to be made here about the Preamble. Though it does not make any specific reference to any community or persons, its objective is to ensure social, political and economic justice. The Preamble thus addresses the needs of the persons with disability to larger extent in general terms.

MAHATMA GANDHI AND BHAGAT SINGH: PERCEPTIONS OF FREEDOM
Author: Mansavi Patyar

Mahatma Gandhi and Bhagat Singh are regarded as the legendary leaders committed towards Indian freedom movement. However, their means were different. Mahatma Gandhi spearheaded a civil disobedience movement founded on the principles of non-violence and Satyagraha. While Bhagat Singh waged a revolutionary armed struggle based upon violence, who inspired youth to participate in this freedom movement. Bhagat Singh was executed while he was only 24 years old. In contrast, Gandhi lived a long life and India succeeded in gaining freedom under his leadership. Both hailed as national heroes yet history has witnessed the prominence of Mahatma Gandhi in Indian freedom. Furthermore, it is evident that as a young lad, Bhagat Singh’s inspiration was Mahatma Gandhi who actively took part in the non-cooperation movement and was a believer to get freedom under Gandhi’s leadership. But when Gandhi called off the movement following the Chauri Chaura riot in 1922, Bhagat Singh became disenchanted with Gandhism and gradually veered towards the tenets of armed revolutionary struggle. So, the present study will try to highlight whether it is actually correct to say that Bhagat Singh was a total contrast to Mahatma Gandhi? Their distinctly different approaches have spawned many controversies and even conspiracy theories. But Gandhi was admirer of Bhagat Singh and publicly acknowledged his patriotism on many occasions. There are some questions like: What were the reasons behind Mahatma Gandhi's success in achieving self rule in India? What were the major causes behind conversion and diversion between Mahatma Gandhi and Bhagat Singh? What are the Revolutionary movements, rules and methods of both to achieve freedom and in what respects they were different? For the present study, the researcher will use the primary as well as secondary sources available on the present research work. Further, the researcher will try to visit living places of both personalities to collect further required information to analyse the conclusion with deeper study of the proposed topic. The present study will also explore the perceptions of both leaders regarding each other and Gandhi’s role in Bhagat Singh’s defence?

CORRUPTION AS AN ECONOMIC, CULTURAL, SOCIAL AND POLITICAL PROBLEM
Author: Suman Saharan, Pawan Kumar

Corruption is considered to be one of the greatest impediments on the way towards progress for developing country like India. The economic, social and cultural structure of our country is very strong; however, due to the menace called- corruption, it has been adversely affected and has become defenseless against the forces of anti-social elements. According to Shri N. Vittal, Former Chief Vigilance commissioner, the first stage in the dynamics of the rule of law is the framing of effective rules and laws, which are equipped to hinder the ever-rising escalation of the corruption graph. It is in this context that the Prevention of Corruption Act, 1988 becomes highly significant.

DAISAKU IKEDA’S PEACE DIALOGUES: A CRITICAL EVALUATION
Author: Anshul Sharma

This research paper proposes to critically analyze the theme of peace in the dialogues of Daisaku Ikeda, the founding President of SokaGakkai International (SGI), with the cutting-edge thinkers and leaders across the globe. SokaGakkai International is a Buddhist lay organization founded on lines of SokaGakkai(based on Nichiren Buddhism) to emphasize on human revolution and world peace. Daisaku Ikeda has had many open dialogues with various world leaders. Only few of all the dialogues are being analyzed in this research paper to discover the theme of peace in his life and efforts. This paper has been organized into three parts. Firstly, the general introduction to peace and its requirement in present context has been explained. The destructiveness of war and its futility usually tends to lead to a negative definition of peace. So the second part focuses on bibliographic events in the life of Daisaku Ikeda to analyse the theme of peace. In the third part, the researcher has attempted to critically evaluate few of the dialogues of Daisaku Ikeda with leaders worldwide. The role of dialoguehas emerged as a central theme in the search for enduring alternatives to violence and to war when other alternatives to peace have not been so effective in implementation. The attention to the role of dialogue has developed in different domains as a tool to establish and promote peace. This analysis points to the fact that sustainable peace can be endured by means of open and creative dialogue and that the establishment of a peaceful civilization depends in large measure on dialogue that is communicative and capable of sustaining a sense of trust and a responsiveness that makes everyone a protagonist for a culture of peace.

RELEVANCE OF FORENSIC SCIENCE IN LAW AND ITS IMPORTANCE IN CRIMINAL INVESTIGATION SYSTEM
Author: Vikram Singh

The word forensic comes from the Latin term forensis, meaning "of or before the forum." The history of the term originates from Roman times, during which a criminal charge meant presenting the case before a group of public individuals in the forum. Both the person accused of the crime and the accuser would give speeches based on their sides of the story. The case would be decided in favor of the individual with the best argument and delivery. This origin is the source of the two modern usages of the word forensic – as a form of legal evidence and as a category of public presentation. In modern use, the term forensics in the place of forensic science can be considered correct, as the term forensic is effectively a synonym for legal or related to courts. However, the term is now so closely associated with the scientific field that many dictionaries include the meaning that equates the word forensics with forensic science.

EUTHANASIA – “RIGHT TO DIE” LEGAL & MORAL QUESTION
Author: Ramanjit Kaur

In our day to day life, we often come across terminally ill patients that are bedridden and are totally dependent on others. Looking at them, we would say that death would be a better option for them rather than living such a painful life; which is painful physically as well as psychologically. This research paper deals with one of the most debated subjects in the world, i.e., Euthanasia or Right to Die. The debate is regarding the morality and legalization of euthanasia. This debate is a continuing one as some people are of the view that life is sacred and no one has got the right to end it whereas on the other hand some say that life belongs to oneself and so each person has got the right to decide what he wants to do with it even if it amounts to dying.
The Constitution of India guarantees ‘Right to Life’ to all its citizens. The constant, ever-lasting debate on whether ‘Right to Die’ can also be read into this provision still lingers in the air. On the other hand, with more and more emphasis being laid on the informed consent of the patients in the medical field, the concept of Euthanasia in India has received a mixed response. In this paper, some basic issues regarding euthanasia are discussed and then it is left to the reader to decide which course would be better: legalizing or not legalizing euthanasia

UNIVERSAL BROTHERHOOD: A VISION OF MAHATMA GANDHI IN THE CONTEXT OF SANT NIRANKARI MISSION
Author: Sangeeta Hasija

Gandhi taught the gospel of brotherhood by not only preaching it rather by practicing it in his whole life. His teachings have a universal appeal. He believed in the essential unity of man and the underlying unity of all the nations. He did not make any distinctions between religions, nations or races. "I have known no distinction between relatives and strangers, countrymen and foreigners, white and coloured, Hindus and Indians of other faiths, whether Musalmans, Parsis, Christians or Jews" .
With this philosophy in mind, he acted as a torchbearer for the people living in the darkness of ignorance, narrow-mindedness, hatredness, violence and otherness.
There is no doubt that we are living in a world of increasing violence and confusion and it is felt that the post-modern human civilization is going through a crisis. Individually human beings feel alienated from the community and now a days there is much more despair and sorrow among them. The world is torn apart in perpetual conflicts, wars and social divisions. And in all social relationships, as MacIntyre observes 'truth has been displaced as a value and replaced by psychological effectiveness' .

ENVIRONMENTAL CHALLENGES AND SUSTAINABLE DEVELOPMENT: A STUDY IN GANDHIAN PERSPECTIVE
Author: Manish Sharma

It has been observed throughout the world that during the recent years, the incidents of natural calamities are increasing day by day. And everyone knows that due to the disturbance/Imbalance in environment, these calamities are occurring everywhere. The recent incident of July, 2013 of Uttarakhand (INDIA) can be quoted here. But on the other hand, at the adjoining place in Uttarakhand, the famous place related to Chipko Movement (Hug the Trees Movement) of 1970-73 where no such causality is reported so far explains many things here. But the question arises here is that the present nature of development and Sustainable Development is the real cause for the same or not. Further, the researcher intends to study that alongwith the development, the concept of Disaster Management should also be developed so that if in near future such (e.g. Uttarakhand) type of situations arises how the precious lives can be saved by providing them medical and other necessary facilities at that moment for their survival. So question arises here that the present form of development is for whom and for what purpose and at what cost or at the cost of humanity or we need to redefine the concept of Sustainable Development in our own comfort zone. The present paper deals with eight parts with the introduction, a case study of Uttarakhand Tragedy with what went wrong during the same and what the Gandhian Scholars of that region have to say on this. The next part deals with the need for the disaster management and its action plan with the future suggestions. In the end the researcher has tried to bring the ground realties also after the tragedy and how in the present the same kind or worst situations are handled after learning the new lessons. Most of the data for this article is collected through the newspapers (e-additions), stories coming up from different segments and through personal visits to the affected areas.
